What if my background check is delayed?

What to do when your NICS check comes back as 'Delayed.'

If your NICS check is delayed, the FFL will let you know. The firearm remains at the FFL while the check is resolved. You'll receive a GatSwap notification.

NICS has 3 business days to respond. If they don't, the FFL may release the firearm at their discretion. Some FFLs will wait longer to be cautious — this is their right.

Steps you can take

  • Contact the NICS Appeal Services Team at (877) 324-6427 to inquire about the delay.
  • If you believe the delay is due to an error, you can file a NICS Voluntary Appeal File (VAF) to have your record flagged for faster future processing.

GatSwap holds the trade open for up to 15 business days during a NICS delay. If unresolved after that, the trade may need to be unwound.
