Terms of Service

By accessing or using GatSwap, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our platform.

GatSwap reserves the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the updated terms. We will notify users of material changes via email or in-app notification.

You must be at least 18 years of age (or 21 in jurisdictions where required) to use GatSwap.

You must not be a prohibited person under federal law (18 U.S.C. 922(g)) or applicable state law.

You must provide accurate, current, and complete information during registration and maintain the accuracy of that information.

You must successfully complete our identity verification process before initiating any trades.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must immediately notify GatSwap of any unauthorized use of your account or any other breach of security.

You may not share, transfer, or sell your account to another person.

GatSwap may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to the platform or other users.

GatSwap is a platform that facilitates the legal trade and transfer of firearms between verified users through licensed Federal Firearms License (FFL) dealers.

All firearm transfers must be completed through an FFL dealer in our verified network. GatSwap does not sell, purchase, or take possession of firearms.

Listings must accurately describe the item, including make, model, caliber, condition, and any modifications.

Users are prohibited from listing items that are illegal under federal or applicable state law, including but not limited to unregistered NFA items, stolen firearms, or firearms with obliterated serial numbers.

All transactions facilitated through GatSwap must comply with applicable federal, state, and local laws.

Users must cooperate with the compliance check process, including background checks conducted by FFL dealers.

GatSwap's compliance engine provides guidance but does not constitute legal advice. Users are responsible for ensuring their transactions comply with all applicable laws.

GatSwap may decline to process transactions that our compliance systems flag as potentially non-compliant, even if no law has been violated.

GatSwap charges platform fees for facilitating trades. Current fee schedules are available on our pricing page.

FFL dealers set their own transfer fees, which are displayed on their profile and at the time of transfer selection.

All fees are non-refundable once a transaction has been completed, except as required by law.

GatSwap reserves the right to change its fee structure with 30 days' notice to users.

All content, features, and functionality of GatSwap (including text, graphics, logos, and software) are owned by GatSwap Inc. and are protected by copyright, trademark, and other intellectual property laws.

Users retain ownership of content they post (such as listing descriptions and images) but grant GatSwap a non-exclusive license to use, display, and distribute that content on the platform.

GatSwap provides the platform on an 'as is' basis and makes no warranties regarding the accuracy, reliability, or availability of the service.

GatSwap is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

GatSwap is not a party to trades between users and is not liable for the conduct of any user or FFL dealer.

GatSwap's total liability shall not exceed the amount of fees paid by you in the twelve months preceding the claim.

Any disputes between users should first be addressed through GatSwap's dispute resolution process.

Disputes between you and GatSwap shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Dallas, Texas.

You agree to waive any right to participate in a class action lawsuit against GatSwap.

You may close your account at any time by contacting support. Account closure is subject to completion of any pending transactions and applicable data retention requirements.

GatSwap may terminate or suspend your account immediately for violations of these terms, fraudulent activity, or as required by law.

These terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions.
